FCC to CBS:
Despite Appeal, 'Wardrobe Malfunction' Will Cost $550K

It seems hard to believe that pesky "wardrobe malfunction" from the 2004 Super Bowl is still in the news...but it is.

The FCC on Wednesday announced that it would uphold the $550,000 indecency fine it levied on CBS after the incident, despite a lengthy appeal from the network.

From MarketWatch: "CBS had argued that the halftime show was not indecent, and that the commission's definition of indecency was 'unconstitutionally vague' and too broad. The network also said that the broadcast of Jackson's breast was accidental, and therefore couldn't be characterized as willful."

The FCC disagreed.
